Sioux Falls Landlord-Tenant Rules

Sioux Falls adds local rules on top of South Dakota landlord-tenant law. Here is what is different, with the city code or agency page behind each rule.

Habitability/code enforcement & complaint lineRepairs are handled through complaint-based code enforcement. Tenants should document the problem with photos, the date, time and exact address, check the lease, and contact the owner or manager first. If the problem is not fixed, report it online at siouxfalls.gov/report ('Report a Concern (Property Maintenance)'), or call Property Maintenance at 605-978-6900 for plumbing, electrical, mechanical, fire-protection and broken door or window issues. Call Environmental Health at 605-367-8760 for garbage, rubbish and nuisances. Inspectors contact the owner and visit the property, and tenants should be ready to let them in. Violations lead to a notice of violation, then citations with rising fines. Cases unresolved after three citations go to the City Attorney's Office.
The City page cites no code chapter. It does not mention rental registration, and none was found.
Local fair housing enforcementThe City's Human Relations Office enforces the City's anti-discrimination ordinance, including in housing, and takes complaints: (605) 367-8745, human.relations@siouxfalls.gov, City Hall, 224 W. Ninth St. (by appointment). Housing complaints may also be filed with the South Dakota Division of Human Rights or HUD.
The protected classes under Chapter 98, including whether source of income is covered, and the filing deadline were not verified.
State preemptionSouth Dakota bars local governments from enacting, maintaining or enforcing rent control on private residential property.
