Warranty Deed in Utah

A warranty deed transfers real estate with the seller's promise that the title is good. Before you record it, check your state's signing and recording rules below and your county recorder's formatting rules (margins, preparer and return-address blocks, transfer-tax forms) — recorders reject deeds that miss them.

What Utah law says

Signing and recording a deedA deed is entitled to be recorded with the county recorder when it carries a notary's certificate of acknowledgment (or proof of execution or jurat). A deed conveying title must name the grantees, give a mailing address for tax notices, and include a legal description of the property. A deed conveying land may be accompanied by a water rights addendum signed by the grantor (and by the grantee to acknowledge receipt). The statutes read do not require witnesses.
Notarial acts affecting real property must also follow Utah's Notaries Public Reform Act.
Signing and recording a deedUtah statutes provide short forms for warranty and quitclaim deeds. To be recorded with the county recorder where the property is located, a deed must carry a certificate of acknowledgment (or proof of execution) by a notary or other authorized officer, be an original (or a qualifying electronic document), include a brief caption stating the nature of the document, contain a legal description of the property, and name the grantees with a mailing address for tax notices. A water rights addendum may be submitted with a deed conveying land or water rights.
Section 57-3-101 was amended in 2025 (2025 Utah Laws, 1st Special Session ch. 15). Check with the county recorder for local recording fees and formatting.
