Warranty Deed in Vermont
A warranty deed transfers real estate with the seller's promise that the title is good. Before you record it, check your state's signing and recording rules below and your county recorder's formatting rules (margins, preparer and return-address blocks, transfer-tax forms) — recorders reject deeds that miss them.
What Vermont law says
| Signing and recording a deed | A deed must be signed by the grantor, acknowledged by the grantor before a notary public, and recorded in the town clerk's office where the land is. If the deed refers to a survey prepared after July 1, 1988, the survey must be attached or its recording location cited. A property transfer return must be delivered to the town clerk with the deed. The property transfer tax is generally 1.25% of the value (with a lower rate on part of the value of a buyer's principal residence). The acknowledgment is valid without a notary stamp. Exemptions and other rates are set out in 32 V.S.A. chapter 231. |

| Signing and recording a deed | A deed must be signed by the grantor and acknowledged before a notary public, and recorded in full in the town clerk's office of the town where the land is located. An unrecorded or unacknowledged deed is not effective against anyone other than the grantor and the grantor's heirs. No witnesses are required. A completed property transfer tax return must accompany the deed for recording (the clerk cannot record without it); the general rate is 1.25% plus a 0.22% clean water surcharge, with a lower rate on the first $200,000 of a principal residence. Exemptions from the property transfer tax are listed in 32 V.S.A. § 9603. Rate details: https://tax.vermont.gov/property/property-transfer-tax. |
