Sublease Agreement in Virginia
For a tenant renting their unit, or part of it, to a subtenant. Most leases require the landlord's written consent first — get it, and attach it.
What Virginia law says
| Subletting rules | No statutory consent standard — the lease controls whether subletting or assignment is allowed. But if the rental agreement lets the landlord approve or disapprove a sublessee or assignee, the landlord must approve or disapprove within 10 business days after receiving the prospective sublessee's or assignee's written application (on a form the landlord provides); failing to act within 10 business days is evidence of approval. If there is an assignee or sublessee, the landlord may hold a security deposit from only one party. |
