Sublease Agreement in Wisconsin
For a tenant renting their unit, or part of it, to a subtenant. Most leases require the landlord's written consent first — get it, and attach it.
What Wisconsin law says
| Subletting rules | A tenant under a tenancy at will or a periodic tenancy shorter than year-to-year (for example, month-to-month) may not assign or sublease without the landlord's agreement or consent. Any other tenant (for example, under a fixed-term lease) may transfer the tenant's interest unless the lease expressly restricts transfer. The statute sets no reasonableness standard for consent. Unless the lease or an express release says otherwise, transfer does not relieve the original tenant of lease obligations. An assignment of a lease with more than one year left must be in writing and signed by the assignor. |
