How long does a landlord have to return a security deposit?

Short answer: It depends on the state — deadlines vary widely, many fall between 14 and 30 days after move-out, and a few states set no fixed number of days — and most states require an itemized list of any deductions. Many states penalize landlords who miss the deadline or withhold in bad faith.

How to get your deposit back

  1. Leave a forwarding address in writing — in many states the deadline or penalty depends on it.
  2. Photograph the unit when you move out.
  3. If the deadline passes, send a written demand citing your state's statute from the table below.
  4. If the landlord still doesn't pay, small claims court handles deposit disputes without a lawyer.
